All Kerala Rented Building Owners Association is an organization of the Building Owners who let out their building for rent. They are a minority when compared with the tenants who are wealthier also.
Even the contract between the building owner and tenant is not a valid one, only the Kerala Buildings (Lease and Rent Control) Act 1965 will prevail over the contract. There are only a few ground stipulated in the Act for eviction of the tenant. That too, even eviction on the ground of arrears of rent is flagrantly in favour of tenant. The proceedings can be started only on 25 days notice, which is mandatory, further the rent can be deposited even after the eviction order is passed. If the court finds that there is default of rent and eviction is ordered, the tenant can deposit the rent and avoid being evicted. This may be the only case where a litigant can, by his action choose the out come of a judgement.
